Why We Detained Jones Abiri For 2 Years Without Trial – DSS - Politics -

A counsel to the Department of State Services (DSS), G. O. Agbadua, has given reasons why journalist Jones Abiri, was not given a trial for the two years he spent in detention.

Abiri was arrested by DSS in 2016 and accused of being the leader of the joint revolutionary council of the Joint Niger Delta Liberation Force, a separatist group.

Abiri, the publisher of Weekly Source Newspaper, was arraigned for the first time after two years in July following public outcry. Abiri was granted bail in August.

Thereafter, the Bayelsa-based journalist asked the Abuja federal high court to compel the federal government to pay him N200 million as compensation for spending two years in detention.

Abiri said he was tortured by the DSS while in detention.

However, at the court on Monday, DSS lawyer explained that when a capital crime has been committed as in the alleged case of Abiri, a person can be held in detention without a trial.

“Section 30(3) of ACJA where a suspect is taken into custody and it appears to the police officer in charge of the station that the offence is of a capital nature, the arrested suspect shall be detained in custody, and the police officer may refer the matter to the attorney-general of the federation for legal advice and cause the suspect to be taken before a court having jurisdiction with respect to the offence within a reasonable time,” the counsel said.


“It is of individual right to national security and rule of law, the state itself was a result of individuals submitting their powers, their rights to the state for protection.


“Reading those provisions, we are of the view that since it’s individual right, it cannot supersede that of the national security and that bail in capital offence is not as of right.”


Apparently displeased with Agbadua’s statement, Samuel Ogala, counsel to Abiri, disagreed with the DSS lawyer.
Abiri’s counsel argued that his client’s detention was illegal and there is no court order to that effect.

“What is rule of law and national security? It is the duty and responsibility of the court to say yes, this case is a capital offence or whether an applicant is entitled to bail or not,” he said.
“It is not the responsibility of the state security service to sit in their office, arrest, detain and punish a person.
“The issue of rule of law and national security is very clear, what I want the court to understand is that the applicant’s detention is criminal intimidation and it is punishable.”
After listening to counsels, the presiding judge, Justice Nnamdi Dimgba, adjourned the matter till September 13.

Matthew Seiyefa Recalls Redeployed DSS Officers - Politics -

The acting Director General of the Department of State Services , Mr Mathew Seiyefa , has recalled officers he transferred out of the headquarters of the agency when he resumed office on August 1 .

The decision to recall the officers followed the open directive given Seiyefa by the Chief of Staff to the President , Mr Abba Kyari , who was said to have scolded the new DSS boss for carrying out reorganisation in the agency without clearance from the Villa .

Seiyefa became the acting DG of the Service following the shocking sacking of its erstwhile DG , Mr Lawal Daura.

The then acting President , Prof. Yemi Osinbajo (SAN), who sacked Daura , ordered him to hand over to the most senior officer in the agency .

Daura, who hails from Katsina State, the home state of President Muhammadu Buhari , was also handed over to the police for debriefing .

President Buhari was not in Nigeria when Daura was sacked .

Daura was relieved of his position because of the role he played in the deployment of operatives in the National Assembly, an action that portrayed the Federal Government as anti -democratic .

It was speculated then that Daura took the action in conjunction with some people in the Villa , without the knowledge of Osinbajo .

Seiyefa , who was then serving at the Institute of Security Studies , Bwari , Abuja , immediately carried out some reorganisations immediately he assumed office.

Among those he transferred were the Director of Operations , Mr Bassey Eteng , and another Director , Grace Kentebe .
Both of them were among those that Kyari asked Seiyefa to return to their duty posts .

A source close to the agency told our correspondent in Abuja on Monday night that , “ There is tension everywhere because the directive has been complied with by personnel , most especially by those who instigated it .

“ Both Eteng and Kentebe have reported . Personnel morale is at its lowest ebb .

“ Even quite a significant number of the personnel of northern extraction are not happy with the Chief of Staff because they said himself and the ousted DG had not been good to the service.

“ Meanwhile , there is every possibility that the service may witness an unprecedented protest against the undue interference in the affairs of the service by the Chief of Staff to the President . ”

Our correspondent gathered that the Presidency had yet to decide on whether to confirm Seiyefa or appoint another officer as a replacement for Daura.

Some members of the Presidency cabal were said to have been making moves aimed at frustrating the confirmation of the acting DG because of political interests .

The aides of the President , who were said not to be happy about the unceremonious sacking of Daura, were also said to be lobbying to have a say in who would replace him .

Daura, it was gathered, had nominated Eteng as a “ worthy successor” and could be useful to the cabal ahead of the 2019 elections.

The cabal is believed to be considering other options , including the possibility of appointing a substantive DG outside the service.

Meanwhile , the Ijaw Youth Council Worldwide has faulted the alleged moves by the Presidency to remove Mr Matthew Seiyefa as the DG of the DSS and reinstate the sacked Lawal Daura.

The President, IYC , Mr Eric Omare , said , “ While the IYC recognises the fact that the President of the Federal Republic of Nigeria has the power to hire and fire head of security agencies in the country, we wish to state that the President also has a corresponding mandatory constitutional duty to ensure that such appointments are in line with the Federal Character principle .

“ As of today , Seiyefa is one of the few heads of security agencies in Nigeria from the southern part of the country , hence it would amount to grave violation of the Federal Character principle of the constitution to replace Seiyefa , who was appointed less than a month ago , with a northerner as alleged .

“ Consequently , the IYC strongly calls on President Buhari to put a stop to the Satanic plan by the Presidency cabal to replace Seiyefa as Director General of the DSS because there is no basis for it .

Seiyefa is doing a great job in repositioning the SSS and what he deserves is encouragement from the Presidency and not a replacement. ”

The Edo State government has evacuated 15 children from the God’s Own Orphanage, in Benin, pending the conclusion of on-going investigation into the case of a Elo Ogidi, who was allegedly stolen from the Christ Embassy Church, Oregun, Lagos and found at the orphanage in Benin.
 
 
Four-year-old Ogidi was stolen during a church service in July and found last Friday, at the God’s Own Orphanage, when policemen raided the facility after a tip-off.

The police have arrested the Proprietress of the Orphanage Home, Kehinde Blessing Imarhiagbe, for complicity in the alleged theft of Elo Ogidi. Read  here
 
Speaking with journalists on Friday, after sealing off the home, located at 25 Davies Street, off 2nd Dr. Garrick Layout, the Commissioner for Women Affairs and Social Development, Magdalene Ohenhen, said the management of the home did not follow due process in admitting Elo into the facility.
 
She said during the operation, the police also discovered that the orphanage had three other children who were not documented with the ministry as required by law.

“The procedure is that before you accept a child into an orphanage in the state, the operator of the home must inform the state government through the state’s Ministry of Women Affairs and Social Development.
 
“The owner of God’s Own Orphanage didn’t inform government before admitting Elo, who was reported missing in a church in Lagos, before accommodating her in the home,"
